CHAPTER 04 · NETHERLANDS

Wages during sickness

Short answer

In the first year of sickness, an employee is generally entitled to at least 70% of their wages and no less than the statutory minimum wage. At least 70% remains applicable in the second year, but the supplement up to the minimum wage does not always apply. The contract and collective labour agreement (CAO) may be more favourable.

Step by step

  1. 1

    Check the contract and CAO

Check the percentage, any waiting days, allowances and additional arrangements. Temporary agency and on-call contracts require extra care.

  2. 2

    Compare the payslip

Compare hours, basic pay, allowances, accruals and deductions with the period before the sickness report.

  3. 3

    Request a calculation

If wages or allowances differ, ask the employer to explain the calculation in writing.

  4. 4

Check whether a supplement may be available

If your income is below the social minimum, you may qualify for a supplement from UWV. Check the current official conditions.

Deadlines and responsibilities

  • Employer: process wages and payslips in accordance with the law, contract and CAO.
  • Employee: report discrepancies promptly and keep evidence.
  • UWV: assess entitlement under the Ziektewet or a possible supplement in specific situations.

Documents and evidence

  • Employment contract and collective labour agreement (CAO)
  • Payslips before and during sickness
  • Overview of hours and allowances
  • Written wage calculation

WHEN HELP IS NEEDED

Do not wait while a deadline is running

If no payment has been made or you cannot pay essential bills, contact the payer immediately in writing and, where necessary, seek independent legal or debt assistance.
